This Privacy Policy explains how SocialChat, Inc. (“SocialChat,” “we,” “us,” or “our”) handles personal information when you visit trysocialchat.com, create an account, or use our chat-automation platform and related services (together, the “Services”). By using the Services, you agree to the practices described here.
1. Overview
SocialChat helps businesses and creators automate conversations across messaging channels such as Instagram, Facebook Messenger, WhatsApp, Telegram, SMS, and email. To provide these features we process two broad categories of data: information about our own customers (the people who sign up for SocialChat) and information about the end users who interact with our customers’ connected accounts.
Where we determine why and how personal information is processed, we act as a controller. Where we process information on behalf of a customer running automations, we act as a processor and handle that data according to our agreement with that customer.
2. Information We Collect
Information you provide
Account and profile details (name, email address, password, business name), billing information processed through our payment providers, the content of automations and flows you build, and anything you send us through support requests or surveys.
Information collected automatically
Device and usage data such as IP address, browser type, pages viewed, referring links, and interactions with the dashboard, collected through cookies and similar technologies described below.
Information from connected platforms
When you connect a messaging account, we receive data from that platform’s API as permitted by the scopes you authorize — for example, profile names, usernames, profile pictures, message content, and contact identifiers for the people who message your connected accounts. We use this data only to operate the automations you configure.
3. How We Use Information
We use personal information to:
- Provide, maintain, and improve the Services;
- Deliver and route automated messages on behalf of our customers;
- Authenticate users and secure accounts;
- Process payments and manage subscriptions;
- Respond to support requests and send service-related notices;
- Analyze usage to develop new features and troubleshoot issues; and
- Detect, prevent, and address fraud, abuse, and security risks.
We do not sell personal information, and we do not use the content of end-user messages for advertising.
4. Legal Bases (EEA/UK)
If you are located in the European Economic Area or the United Kingdom, we rely on the following legal bases: performance of a contract (to deliver the Services you request), legitimate interests (to secure and improve the Services), consent (for certain cookies and marketing), and compliance with legal obligations. You may withdraw consent at any time where consent is the basis for processing.
6. Messaging Platform Data
Our use of information received from Meta APIs (Instagram and Facebook) adheres to the Meta Platform Terms and Developer Policies, including any limited-use requirements. We only request the permissions needed to operate the features you enable, and we use platform data solely to provide those features back to you.
If a connected platform’s data is no longer needed for an active feature, we delete or de-identify it in line with the retention practices below. You can disconnect a platform at any time from your dashboard, which revokes our ongoing access.
8. Data Retention
We retain personal information for as long as your account is active or as needed to provide the Services, then for a limited period afterward to comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods vary by data type and the purpose for which it was collected.
9. Security
We use administrative, technical, and organizational safeguards — including encryption in transit, access controls, and regular review of our practices — to protect personal information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
10. International Transfers
We may process and store information in countries other than the one in which you live. When we transfer personal information across borders, we use appropriate safeguards, such as standard contractual clauses, where required by applicable law.
11. Your Privacy Rights
Depending on where you live, you may have the right to access, correct, delete, or port your personal information, to object to or restrict certain processing, and to opt out of marketing. To exercise these rights, contact us at privacy@trysocialchat.com. We will respond within the timeframe required by applicable law. If SocialChat processes your data on behalf of one of our customers, please direct your request to that customer, and we will assist them as their processor.
12. Children's Privacy
The Services are not directed to children under 16, and we do not knowingly collect personal information from them. If you believe a child has provided us information, contact us and we will delete it.
13. Third-Party Services
The Services may link to or integrate with websites and tools we do not control. This Policy does not apply to those third parties, and we encourage you to review their privacy practices separately.
14. Changes to This Policy
We may update this Policy from time to time. When we make material changes, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Services after an update means you accept the revised Policy.
